Landlords are required by law to ensure that your property is kept in good repair. 

When this does not happen, we may be able to help by acting on your behalf under Section 11 of the Landlord and Tenant Act 1985. In addition, the Homes (Fitness for Habitation Act) seeks to improve housing conditions, and it is a requirement as an implied covenant that homes should be ‘Fit For Human Habitation’. The ‘fitness’ will be particularly relevant as it demands adequate ventilation and a home free from damp.

The Act covers all shorthold and secure tenancies, whether a social landlord owns the property, i.e. Local Authorities and Housing Associations, or a private landlord, which could be an individual landlord or a company.

Symptoms of Disrepair

Damp & Mould Issues

Damp can be caused by a variety of problems which often relate to the structure of your home and can cause health problems for you and your family. Too often, landlords are content to paint over the symptom rather than properly repairing the cause to prevent it from happening again. The Fitness for Habitation Act imposes additional duties on landlords to provide a home free from damp and with adequate ventilation.

Leaks

Does your property suffer from leaks internally? Is it being caused by a leaking roof or from a dwelling above? If so your landlord should repair the problem, redecorate and compensate you for your damaged items.

Vermin

Your landlord should ensure that rats, mice and cockroach infestations are resolved and their entry into the property prevented.

Heating Problems

Your home must have an adequate and reliable source of heating and hot water. Broken boilers must be addressed urgently.

Drains & Gutters

Should be clear at all times and should not overflow.

Structural Cracks

Landlords must address structural movement, which causes worry and distress for tenants.
